Pakistan Introduces Strict Cross-Border Data Transfer Rules to Safeguard National Sovereignty

The Government of Pakistan has proposed sweeping new rules governing the cross-border transfer of government data, making national sovereignty, security, and sovereign control the cornerstone of its new National Data Governance Policy 2026. The policy introduces a comprehensive framework aimed at protecting sensitive public-sector data from unauthorized foreign access while enabling responsible international data cooperation.

Under the proposed policy, all government institutions will be required to classify data according to its sensitivity before transferring it outside Pakistan. Sensitive, confidential, and nationally important government data will not be allowed to leave the country without fulfilling strict legal conditions and obtaining prior approval from the Pakistan Digital Authority (PDA).

The policy establishes a formal approval mechanism for cross-border data transfers, ensuring that any overseas processing or remote access to government data is lawful, justified, and supported by adequate security safeguards. It also requires organizations handling government data abroad to comply with Pakistan’s legal framework, technical security controls, contractual obligations, and audit requirements.

A central feature of the policy is the preservation of Pakistan’s sovereign control over government data. The document states that government data will remain under Pakistan’s legal authority and operational control, with cross-border transfers treated as exceptions rather than the norm. The framework introduces residency tiers, requiring restricted, confidential, and sensitive personal data to be hosted and processed within Pakistan unless specifically approved otherwise.

The government has also outlined measures to prevent unauthorized foreign jurisdiction access to official data. If a foreign court or regulatory authority seeks access to Pakistani government data, the concerned public body must immediately notify the Pakistan Digital Authority and may only disclose the information in accordance with Pakistani law and applicable mutual legal assistance arrangements.

While strengthening data protection, the policy also promotes responsible international cooperation. The Pakistan Digital Authority will work with international organizations, standards bodies, and foreign counterparts to advance Pakistan’s interests in global data governance and facilitate secure cross-border data flows that protect national interests. The policy also allows international cooperation during public emergencies, cross-border crime investigations, public health crises, and other matters of compelling public interest under clearly defined safeguards.

To improve accountability, every government agency will be responsible for implementing stronger data governance, security, and compliance measures. Public bodies will be required to maintain proper data inventories, classify information, report incidents, respond to citizen data requests, and undergo regular compliance reporting and audits under the supervision of the Pakistan Digital Authority.

The National Data Governance Policy 2026 positions government data as a strategic national asset held in trust for the people of Pakistan. It emphasizes that data governance should balance innovation and international cooperation with national security, citizen privacy, and the country’s sovereign control over public-sector information.
